Terms of Service

1. Agreement and eligibility

These Terms govern https://www.marqueengine.com and the MarqueEngine service operated by Yoshida Social Lab LLC, doing business as MarqueEngine ("we," "us," or "our"). By creating an account or using the service, you agree to these Terms. If acting for a brokerage or company, you represent that you may bind it. You must be at least 18 and legally able to enter this agreement.

Our Privacy Policy describes how we handle personal information.

2. Accounts and professional use

Provide accurate account information, protect your credentials, and promptly report unauthorized access. Subject to these Terms, we grant you a limited, nonexclusive, nontransferable right to use MarqueEngine for your authorized automotive or marine brokerage activities. You may not resell account access.

3. Listing facts, media, and authority

You are responsible for every asset you create or publish and represent that you have authority to market it and use its photographs, trademarks, specifications, provenance, and other content. Verify title, ownership, availability, asking price, measurements, mileage or engine hours, condition, tax status, location, and all representations before publication.

MarqueEngine does not inspect, authenticate, appraise, broker, or guarantee any vehicle or vessel.

4. AI output and required review

AI output may be inaccurate, incomplete, repetitive, or unsuitable. You must review, correct, and approve all generated copy before publishing or sending it. Do not rely on the service to verify provenance, specifications, legal disclosures, intellectual-property rights, or regulatory compliance. MarqueEngine provides software assistance, not legal, valuation, brokerage, financial, tax, maritime, or automotive advice.

5. Showcases and enquiries

You control whether an asset is publicly showcased. You are responsible for the accuracy and legality of its content and for promptly unpublishing unavailable inventory. You must have a lawful basis and required permissions to use enquiry information and to contact a prospect by email, telephone, or text. Honor opt-outs and comply with applicable marketing, privacy, sanctions, export, do-not-call, and consumer-protection rules.

6. Acceptable use

You must not use MarqueEngine to market stolen, counterfeit, embargoed, unlawfully imported, or misrepresented assets; infringe privacy, publicity, or intellectual-property rights; publish deceptive statements; send unlawful unsolicited communications; introduce malware; bypass access controls; scrape the service; interfere with its operation; or access another account without permission.

7. Your content and our technology

You retain rights you hold in submitted content and grant us a limited worldwide license to host, reproduce, process, transmit, and display it only as needed to provide, secure, and lawfully operate the service. As between you and MarqueEngine, you may use output generated for your account, but we do not guarantee that output is exclusive, copyrightable, or free from third-party claims. We and our licensors retain all rights in the service, brand, designs, and underlying technology.

8. Third-party services

The service relies on providers for hosting, authentication, storage, sign-in, and AI generation, including Lovable and Google. Their availability and terms may affect features. We are not responsible for independently operated third-party services.

9. Service changes and account closure

We may change or discontinue features and may suspend access when reasonably necessary for security, unlawful conduct, material breach, or harm. You may request account closure and a copy of your data by emailing chris@yoshidasociallab.com. We may retain information where required by law or reasonably needed to resolve disputes.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND AI OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT, AND DO NOT WARRANT UNINTERRUPTED OPERATION, ACCURATE OUTPUT, QUALIFIED LEADS, SALES, OR REVENUE.

11. Limitation of liability

To the extent permitted by law, MarqueEngine and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, business, opportunities, reputation, or data. Our aggregate liability will not exceed the greater of US $100 or fees you paid us in the 12 months before the event. Nothing excludes liability that cannot legally be limited.

12. Indemnity

If you use the service for business, you will defend and indemnify MarqueEngine against third-party claims arising from your content, an asset or transaction, infringement, unlawful collection or use of personal information, marketing communications, or material breach of these Terms.

13. Governing law and general terms

California law governs these Terms, excluding conflict-of-law rules. Subject to mandatory law, courts in Monterey County, California have exclusive jurisdiction. If a provision is unenforceable, the remaining terms remain effective. These Terms do not create an agency, partnership, employment, brokerage, fiduciary, or joint-venture relationship.

14. Changes and contact
